A re-application for a new housing development in Kingsmuir has been submitted to the Angus Council planning department.
The renewed application, which is for land at Kingston Place, is for 23 homes including roads and ancillary works.
When the original application was made in 2013 the Scottish Environment Protection Agency (SEPA) objected on the grounds that the “proposed development may place buildings and persons at flood risk”. The application was then withdrawn in order that the developers, Ford Design Ltd, acting on behalf of the Allied Irish Bank, could address the concerns raised by the SEPA report.
SEPA intended to maintain its objection to the application unless “further information [could be supplied] to demonstrate that the planning application complies with SPP (Scottish Planning Policy).”
SEPA had a number of concerns about the plans including “that there has only been a qualitative assessment of the risk of flooding from out of bank flow from the ditches”. It was noted that the “new culvert is proposed to be oversized to accept some flows from the watercourses/ditches up to 1 m3/s” and suggested that the culvert be sized to hold flows from the whole catchment.
Comment was sought from the planning/flood prevention authority that suitable cambers/speed bumps in the road could be maintained in the long term as flood mitigation.
SEPA stated: “Any maintenance works by services personnel or road maintenance crews could accidentally alter the anticipated flow paths of water along a road.”
Tricia McGregor, principal consultant, at Envirocentre, responded: “The developer is happy to commit to providing a culvert with an oversized capacity in excess of 1 m3/s to alleviate the existing problems with surface water runoff in the area and ensure the development area is not at risk of flooding.
“He would also be happy to accept a planning condition that if suitable road cambers and speed bumps are incorporated within the final drainage design that these would be maintained in the long term flood mitigation strategy.”
